These Terms & Conditions (“Terms”) govern every purchase of goods, and every application for a connectivity service (fibre, fixed LTE or 5G), made through Fibre Boyz (Pty) Ltd trading as Fibre Boyz · Reg 2017/386810/07 · VAT 4750287957 (“Fibre Boyz”, “we”, “us”). By placing an order or submitting a connectivity application on this site, you agree to these Terms.
1. Who you’re dealing with
Fibre Boyz (Pty) Ltd, trading as Fibre Boyz, registration number 2017/386810/07, VAT number 4750287957, is based at 8 Greenstone Place, Stoneridge Office Park, Block A North, First Floor, Greenstone Hill, Johannesburg, 1609. Every price on this site is quoted in South African Rand and includes VAT unless clearly stated otherwise.
2. Buying products
2.1 Orders and acceptance
Placing an order is an offer to buy. We accept your order when we confirm it (typically by email) or, for card and instant EFT payments, once payment clears. We may decline or cancel an order — for example if an item is out of stock, a price was displayed incorrectly, or we suspect fraud — in which case we’ll refund anything already paid.
2.2 Delivery
We aim to dispatch within one working day and deliver countrywide, tracked, within 1–5 working days. Delivery is free on orders over R1 000; a flat R99 delivery fee applies below that threshold. Risk in the goods passes to you on delivery; ownership passes once we’ve received payment in full.
2.3 Your right to cancel (cooling-off) — Electronic Communications and Transactions Act
Because you bought online, section 44 of the Electronic Communications and Transactions Act, 2002 gives you the right to cancel a purchase, without reason and without penalty, within 7 (seven) days of receiving the goods. To cancel, tell us in writing (WhatsApp or email is fine) and return the item unused and in its original packaging; we’ll refund you within 30 days of receiving your cancellation. This right does not apply to goods made to your specification, sealed goods unsealed after delivery where they cannot be returned for health or hygiene reasons, or a connectivity service you have already asked us to start providing.
2.4 Your rights under the Consumer Protection Act
The Consumer Protection Act, 2008 gives you a separate right, under sections 55 and 56, to goods that are reasonably suitable for their intended purpose, of good quality, and free of defects. If a product fails to meet this standard within six months of delivery, you can ask us to repair, replace or refund it, at your choice. Nothing in these Terms limits or replaces your rights under the Consumer Protection Act.
2.5 Warranty
Every product also carries a warranty on top of your Consumer Protection Act rights, based on its condition: 12 months on new products (mirroring the manufacturer’s own warranty, or longer where theirs runs longer), 12 months on certified-refurbished products (Fibre Boyz’s own return-to-base warranty), and 90 days on pre-owned products (also Fibre Boyz’s own return-to-base warranty). A warranty claim is handled by returning the item to us; we cover reasonable return courier costs for a valid claim. This warranty is additional to, and never instead of, your rights under the Consumer Protection Act — it does not limit them in any way.
2.6 Returns and refunds
To start a return under section 2.3 or a warranty claim under section 2.5, WhatsApp or call us with your order reference and we’ll arrange a courier collection. Refunds are paid back to your original payment method within 30 days of us receiving the returned item, once it’s been checked.
3. Connectivity services (fibre, fixed LTE and 5G)
Fibre Boyz sells connectivity as an Internet Service Provider, billing you and supporting you directly. The physical network — fibre in the ground, or a cellular tower — is owned and operated by network operators such as Openserve, Vumatel, Frogfoot, Octotel, MetroFibre, Evotel, MTN, Vodacom or Telkom, depending on your address and technology. You cannot choose which network operator serves your street or tower, but you choose Fibre Boyz as your ISP.
3.1 Applying and coverage
An application through this site is a request for a connectivity service, not a guarantee of coverage. We confirm actual coverage and installation feasibility at your address before your line goes live, and we’ll let you know within one working day of your application if anything changes. Speeds on fixed LTE and 5G are best-effort and depend on network conditions; speeds on fibre may vary by network operator and package even at the same advertised figure.
3.2 RICA
South African law (the Regulation of Interception of Communications and Provision of Communication- Related Information Act, “RICA”) requires us to verify your identity and residential address before activating a SIM-based or certain fixed-line services. We’ll ask for a certified copy of your ID and proof of residence dated within the last three months (and, for some fixed LTE plans, a recent bank statement). We only use these documents for RICA compliance and your application — see our Privacy Policy.
3.3 Billing, month-to-month terms, and non-payment
Connectivity plans are billed monthly in advance and, unless your specific plan states an initial minimum term, run month-to-month with no lock-in. If a minimum term applies to your plan, we’ll say so clearly before you sign up, along with any early-cancellation terms. If a payment fails or is late, we’ll try to contact you before suspending the service; continued non-payment may lead to suspension and, eventually, cancellation of the service. You can cancel a month-to-month plan at any time by giving us notice (WhatsApp, email or your account settings); cancellation takes effect at the end of your current billing month unless we agree otherwise.
3.4 Fair and acceptable use
“Uncapped” does not mean unlimited at all times. To keep the network fair for every customer, a small minority of extremely heavy or abusive users may have their traffic shaped or their speed temporarily reduced under a Fair Usage Policy — data is never simply cut off for ordinary home use. You may not use our services to send unsolicited bulk communications, to infringe anyone’s rights, to attack or scan networks you don’t own, to resell the service without our written agreement, or for any unlawful purpose. We may suspend a service immediately, without notice, where we reasonably believe it is being used to break the law or to harm our network or another customer.
3.5 Equipment
Some plans include a router or other equipment free of charge, or at a reduced price, subject to a minimum term; where that’s the case for your plan, we’ll say so clearly before you sign up. Equipment installed at your address (an ONT, CPE or similar network box) generally remains the property of the network operator unless we tell you otherwise.
4. Website disclosures (Electronic Communications and Transactions Act, section 43)
In line with section 43 of the Electronic Communications and Transactions Act, here is how to reach us and buy from us: our full name and registration details are in section 1 above; our physical address, phone number and email are on our Supportpage; prices are quoted in Rand and include VAT; delivery and cancellation terms are set out in section 2; and you can review, correct and confirm your order before paying at checkout. If you have a complaint, contact us using the details on the Support page and we’ll aim to resolve it within a reasonable time.
5. Payment
We accept PayFast, Yoco (Visa and Mastercard) and EFT. Card payments are processed by our payment partners under their own security standards — we never see or store your full card details. An EFT order is fulfilled once your payment reflects and clears in our account.
6. Liability
Nothing in these Terms limits any liability that cannot lawfully be limited, or any right you have under the Consumer Protection Act. Subject to that, we are not liable for indirect or consequential loss (for example, lost income from a connectivity outage) except where the Consumer Protection Act requires otherwise, and our total liability for a product or service is limited to the amount you paid for it.
7. Changes to these Terms
We may update these Terms from time to time — for example to reflect a change in the law or in how we operate. The version in force is the one published here at the time of your order or application; we’ll update the “last updated” date above whenever we do.
8. Governing law and disputes
These Terms are governed by the law of the Republic of South Africa. If something goes wrong, please contact us first — most issues are resolved quickly. You also have the right to refer an unresolved consumer dispute to the National Consumer Commission or, for connectivity services, the Internet Service Providers’ Association of South Africa (ISPA) Code of Conduct process.
